Unfair Dismissal

Have you been dismissed and believe it was unfair?

Employees with sufficient qualifying service are generally protected against unfair dismissal. The employer must show a potentially fair reason and must have acted reasonably. Some dismissals are automatically unfair regardless of length of service.

Typical situations

  • You have been dismissed for conduct, capability or redundancy and believe it was unfair.
  • The process felt predetermined or rushed.
  • You were dismissed after raising concerns, taking leave or asserting a right.

Practical first steps

  • Obtain the dismissal letter and the reasons in writing.
  • Consider whether to appeal — but do not let the appeal delay advice on time limits.
  • Gather relevant correspondence and your contract.

How WorkplaceDisputes.uk may assist

  • Assessing the dismissal and the process.
  • Preparing your appeal and the ACAS Early Conciliation notification.
  • Preparing and presenting an Employment Tribunal claim where appropriate.
