What Early Conciliation is
ACAS (the Advisory, Conciliation and Arbitration Service) is an independent public body. Before most Employment Tribunal claims, the person bringing the claim must notify ACAS. ACAS then offers a period of Early Conciliation, in which a conciliator speaks to both sides to see whether the dispute can be resolved without a tribunal.
Taking part in conciliation discussions is voluntary. If the dispute is not settled, or either side does not wish to conciliate, ACAS issues an Early Conciliation certificate. The certificate number is needed to issue a tribunal claim.
You are entitled to appoint a representative to deal with ACAS on your behalf during Early Conciliation.
