The external journey
How the process usually develops
Stage 1
Internal process
The dispute is dealt with through your employer's own grievance, disciplinary or other internal procedure.
Stage 2
ACAS Early Conciliation
In most cases you must notify ACAS before an Employment Tribunal claim can be started. ACAS then offers a period of conciliation, and you may appoint a representative to deal with ACAS on your behalf.
Stage 3
Negotiation / possible settlement
Many disputes are resolved by negotiation or a settlement agreement, either through ACAS or directly between representatives.
Stage 4
Employment Tribunal where necessary
If the dispute is not resolved, a claim may be issued within the applicable time limit. The case is then prepared, evidence organised and the matter presented at a hearing.
